Article 1 - Definitions

In these terms and conditions, the following terms have the following meanings:

Entrepreneur/We/Us: The Bamboovement, registered office at Centrale Groothandelsmarkt 186, 1051 LJ, Amsterdam, registered with the Dutch Chamber of Commerce under number 75425394, VAT number: NL860278347B01;

Consumer/You: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

Product: the offered goods, being sustainable bamboo products and other eco-friendly cosmetic items;

Distance contract: a contract concluded between the entrepreneur and the consumer through our webshop;

Withdrawal period: the period within which the consumer can exercise their right of withdrawal.

Article 3 - Applicability

  • These terms and conditions apply to every offer by Bamboovement and to every contract between Bamboovement and a consumer.
  • Before the contract is concluded, these terms and conditions will be made available to you and published on our website.
  • By placing an order, you agree to these terms and conditions.
  • We reserve the right to change these terms and conditions. Modified terms and conditions apply to all new orders after publication on our website.

Article 4 - The offer and prices

  • All offers on our website are non-binding and may be withdrawn or modified at any time.
  • All prices in our webshop include VAT and other taxes, unless stated otherwise.
  • Shipping costs are stated separately and amount to €4.95 within the Netherlands. Orders of €30.00 or more qualify for free shipping.
  • We strive to display all product information as accurately as possible, but cannot exclude small variations in color or dimensions.

Article 5 - The order and agreement

  • The agreement is concluded when you receive our order confirmation by email.
  • When ordering, you must provide correct and complete information.
  • You are responsible for the accuracy of the information you provide.
  • We are entitled to refuse or cancel orders in case of suspected abuse or incorrect information.

Article 6 - Payment

  • Payment is made through our online payment service Mollie.
  • Available payment methods are shown during the ordering process.
  • We do not charge additional costs for using certain payment methods.

Article 7 - Delivery

Delivery takes place to the address you specified within the Netherlands or other countries as stated on our website.

Delivery times:

  • Netherlands: 1-2 business days
  • Europe: 3-12 business days
  • Rest of world: 7-32 business days

We genereally work with PostNL or DHL for the delivery of our products. In case of delay, you will be informed by email.

Maximum delivery time: If your order is not delivered within 30 days after ordering, you have the right to dissolve the contract free of charge.

The risk of loss or damage passes to you at the moment the product is physically received by you or by a third party designated by you (excluding the carrier). In case of failed delivery attempts, the risk remains with us until successful delivery.

Article 8 - Right of withdrawal

For all products:

  • You have the right to withdraw from the contract within 14 days without giving reasons.
  • The withdrawal period starts:
  • For products: the day after you (or a third party designated by you) received the product
  • To exercise your right of withdrawal: send a clear statement to info@bamboovement.com

You have 14 days to return the product after notification of withdrawal

Return shipping costs are at your expense (maximum €8.00 reimbursement)

You may unpack and inspect the product to establish its nature, characteristics, and functioning, similar to how you would in a physical store. You should handle the product with reasonable care during this inspection.

You are liable for the diminished value of the product resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the product. This includes damage, excessive wear, or modifications to the product.

We will refund all payments received within 14 days after notification of withdrawal, including original shipping costs.

Article 9 - Excluded from right of withdrawal

The right of withdrawal does not apply to:

  • Products that are made according to your specifications, clearly personalized, or customized specifically for you.
  • Sealed products that are not suitable for return due to health protection or hygiene reasons, and were unsealed after delivery.
  • Other product-specific exclusions, if applicable.

Article 10 - Warranty and conformity

Legal warranty: Bamboovement warrants that the products meet the specifications set out on the Bamboovement website, provided that this warranty does not apply if and when you do not use the product in adherence to the instructions set out on the website. You are entitled to a product that conforms to the contract for at least 2 years.

Warranty claim procedure:

  • Contact us at info@bamboovement.com
  • Send the defective product in original packaging (if possible)
  • Shipping costs for warranty claims are at your expense

Warranty does not apply to normal wear and tear or damage due to improper use.

Article 11 - Liability

  • Bamboovement is not liable for any delay or failure to perform its obligations under these terms and conditions if such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, supply chain disruptions, transportation issues, or other unforeseen events. In such cases, our obligations will be suspended for the duration of the force majeure event.
  • Bamboovement is not liable for any indirect damage or consequential damage, including but not limited to loss of profit, business interruption, loss of business opportunity, loss of goodwill, or any similar damages. Additionally, we are not liable for damages resulting from third-party services, including payment processors and delivery services, or for damages resulting from failed payment processes, data breaches, or cyber incidents beyond our reasonable control.
  • Furthermore, Bamboovement’s liability is in all cases limited to a maximum of the purchase price of the relevant product. This limitation applies to all forms of liability, including but not limited to contractual liability, tort, negligence, and statutory liability, to the extent permitted by applicable law.

Article 12 - Complaints

Complaints procedure:

  • Send complaints as soon as possible to info@bamboovement.com
  • Include your order number and a clear description
  • We confirm receipt within 2 business days
  • We handle your complaint within 14 days

Disputes committee:

  • If we cannot resolve the matter together, you can contact the Thuiswinkel Disputes Committee

Article 13 - Intellectual property

  • All intellectual property rights to our website, texts, images, logos, product designs, and other content belong to Bamboovement or our licensors. These materials are protected by copyright, trademark, design rights, and other intellectual property laws.
  • It is prohibited to copy, reproduce, modify, distribute, display, license, or use our content or intellectual property without our explicit written permission. Any unauthorized use may result in legal action, including but not limited to claims for damages, injunctive relief, and recovery of legal costs.

Article 14 - Privacy protection

For the processing of your personal data, we refer to our separate Privacy Policy on our website.

Article 15 - Changes to terms and conditions

  • Bamboovement may change these terms and conditions.
  • Changes apply to new orders after publication on our website.
  • For existing agreements, the terms and conditions that were in effect at the time of ordering apply.

Article 16 - Applicable law and disputes

  • Before initiating any legal proceedings related to these terms and conditions or any transaction with Bamboovement, both parties agree to first attempt to resolve the dispute through mediation.
  • The mediation shall be conducted by a mediator appointed by the Thuiswinkel Disputes Committee or another mutually agreed mediation service.
  • If mediation fails to resolve the dispute within 30 days of the appointment of a mediator, such dispute will be exclusively submitted to the competent district court in Amsterdam, the Netherlands.
  • Dutch law exclusively applies to all agreements. The UN Convention on the international sale of goods (CISG) is expressly excluded
